Transaction on the Website is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Website. WishiWish reserves the right, at its absolute discretion and without assigning any reason, to refuse any user from creating an account on the Website or to suspend or cancel an account. WishiWish also reserves the right to suspend or cancel at any time and without notice the account of any user who is found to be in breach of these Terms and Conditions or if any user who in the reasonable opinion of WishiWish is guilty of conduct which is detrimental to the reputation of WishiWish.
You hereby confirm and acknowledge that you shall be solely responsible for maintaining the confidentiality of your user name and password and restricting any unauthorized access and use of this Website using your user name and password. You will be responsible for all access to and use of this Website through your user name and password, including purchase of any Products which results in monetary charges being imposed onto you, whether or not you have the knowledge of or authorize such access and use. - Products and pricing
Seller-
WishiWish is selling the products on the Website which include third party products. WishiWish has legal authority to sell such third party products to the users via the Website.
Admarvels Solutions Private Limited is a listed seller on the Website for its owned branded products and is only a facilitator for the products sold by Admarvels Solutions Private Limited. WishiWish is providing its support to Admarvels Solutions Private Limited, associated with sales through the Website. For the products sold by Admarvels Solutions Private Limited, it shall solely be responsible to the user with respect to product quality, warranty, accuracy, on-time deliveries and respective complaints. Admarvels Solutions Private Limited shall be bound to these Terms and Conditions mentioned hereunder, to the extent related to the sales of its products through the Website.
Products-
All products listed on the Website, their descriptions, and their prices are subject to change from time to time. WishiWish and/or Admarvels Solutions Private Limited reserve the right, at any time, to modify, suspend, or discontinue the sale of their respective products or services with or without notice.
We put every effort to ensure that our Website contains correct information. However, WishiWish makes no warranty as to the accuracy, comprehensiveness, and correctness of products and information on the Website. Purchase of a product on the Website is subject to availability of stock.
We strive to offer you the best possible rates for our products, but WishiWish does not guarantee that these prices will be the lowest in the region, country, or in comparison to other players in the industry. WishiWish reserves the right to change or update the price and/or other details of the product on the Website, at its discretion, without any notice to you. In the event a product or service is listed at an incorrect price or with incorrect information due to typographical error, pricing error, or incorrect information received from WishiWish’s suppliers, WishiWish shall have the right, even after the acceptance of any order, to decline or cancel such order, whether or not the order has been confirmed and/or you have been charged. If you have already been charged and WishiWish cancels your order, the amount will be refunded.
Product specifications such as weight, size, and colour mentioned alongside product images are approximate. There may be slight variations between the displayed images and the actual product.
- Flower Arrangements: Since arrangements are handmade, slight variations may occur. Substitutions may be made due to seasonal or regional availability issues.
- Cakes: All cakes are handcrafted, and variations in design, shape, or finish may occur. Occasionally, flavour or design substitutions may be necessary due to availability constraints.
In all such cases, our team will ensure that the delivered product is as close as possible to the description and will substitute only with items of equal or higher value.
We request you to refer to and follow the care instructions available on the Website for proper handling of cakes, plants, and flowers delivered by us.
- Orders and acceptance of orders
Products with its information are displayed on the Website to invite offers from the user. When you make an order, you are making an offer to purchase, and such offer is subject to acceptance by us. Our communication (email/SMS/push notification) acknowledging your order does not signify our acceptance to your offer. WishiWish reserves the right, after receiving the order, to accept or decline or cancel your offer (in whole or in part). Offer shall be deemed accepted once there is verbal communication with WishiWish’s team or you can reach out to us through the designated Chatbot on our website. No other act or omission on the part of WishiWish shall be considered as acceptance of offer or order by WishiWish. We may require additional verifications or information before accepting any order. In the event of a purchase, you will be required to accurately provide the recipient’s name, contact and shipping address. You agree that, if WishiWish cancels all or a part of your order, your sole and exclusive remedy is that:
WishiWish will not charge your credit/debit card or bank account for the cancelled portion of the order.
For your convenience, WishiWish accepts Visa, Master Card, RuPay, Paypal and American Express Debit Cards, Internet Banking, Digital wallets and UPI. Notwithstanding anything contained herein, any and all payments made by above mentioned options, either through payment gateway on the website or through telephonic/Whatsapp Channel using UPI are subject to specific terms and conditions of such third party payment gateways.
- Substitution policy
In an event where a product that you have ordered is out of stock or unavailable, we will contact you to give an option of an alternate product. If we are unable to get in touch with you, we will proceed with sending you the alternate product since we know that you are sending it to your loved one(s) on a special occasion and we would not want anything to dampen the spirit of the occasion.
- Order modification/ Cancellation policy
WishiWish reserves the right to cancel any order for any reason including under any unforeseen circumstances that may come in the way of your order such as limitations on quantity available for purchase, errors in product(s) or pricing information, or limitations of our credit department. Before cancelling any order, we will contact/notify you.
Orders that are to be delivered the same day are processed immediately and cannot be modified or cancelled. If the order has not been prepared, we will try to accommodate your request. If the order has already been prepared and/or dispatched, it cannot be cancelled or modified and you will be charged for the order.
- Order/Delivery confirmation E-mail and SMS
You will receive an order confirmation on e-mail ID and SMS after order placement on the Website/App which will include all the details of your order, including the order number which will be required in the event you need to contact WishiWish. You will also receive a delivery confirmation e-mail and SMS when your order gets delivered. Please check your registered phone number or email address for details.
- Shipping and delivery
WishiWish shall endeavour to deliver the products to the recipient as per the delivery option selected by the user while placing the order. All orders requesting Same-day delivery must be placed before 2:00 PM. Orders placed after this cutoff will be scheduled for the following day.The delivery time is subject to the location provided for delivery. For the convenience and requirement of the customer, WishiWish charges a nominal amount from customers for selecting fixed time slot delivery and such charges are displayed on the webpage while selecting the timeframe for delivery. However, under fixed time deliveries, WishiWish is obliged to deliver your product as per your opted time but it is always subject to factors beyond its reasonable control (“Force Majeure Events”) including unexpected travel delays from our courier partners and transporters due to weather conditions, political disruptions, strikes, war, lockdown or other unforeseen circumstances. In such cases, we will proactively reach out to you. Please check your e-mails and SMS regularly for updates.
Flowers may be delivered in fully bloomed, semi-bloomed or bud stages. The delivery cannot be redirected to any other address.
Before any festival or major occasions, we suggest you place your order at least 5 (five) days in advance.
Products that are hand delivered cannot be delivered along with courier products. The products may reach the recipient at two different times or days.
For same-day standard time delivery, orders must be received by WishiWish before 6:00 pm, Monday – Sunday, IST. For same-day fixed time delivery, orders must be received by WishiWish before 6:30 pm, Monday – Sunday, IST. For same-day midnight delivery, orders must be received by WishiWish before 7:00 pm, Monday – Sunday, IST.
You acknowledge that the requested delivery time is non-binding. Estimated delivery time depends on the availability of the product and the destination.
Delivery may be affected by Force Majeure Events.
In such cases, we will proactively reach out to you. You must check your e-mails and SMS regularly for updates.
For perishable items like cakes and flowers, we attempt delivery only once. If delivery is not executed, you will still be charged and no re-delivery will be possible. We will consider the order executed in the following cases:
Wrong shipping/delivery address
Recipient not available
Premises locked
Recipient refusing to accept the delivery
If the recipient is not available, they may inform the delivery person to deliver to the gate/reception/neighbour.
Proof of delivery will be provided in case of any dispute.
If no one is available at the delivery address, the order will not be considered late. No refunds or cancellations will be applicable. We will attempt the following:
- Call the recipient
- Leave a note for rescheduling
- Leave the product in a secure place
- Deliver to a neighbour and inform the recipient
Midnight Deliveries
Delivery will be made between 7:00 PM to 11:45 PM on the selected date.
Note: Please select the delivery date one day prior to the occasion.
Fixed Time Deliveries
Delivery may vary by ±30 minutes from the selected time slot.
Delivery of Courier Products-
If delivery is made via third-party courier, WishiWish does not guarantee delivery timelines. These deliveries are subject to the courier partner’s terms.
Delivery dates are estimates and may vary by ±1 day. Deliveries are not made on Sundays or public holidays.
Courier partners may not call before delivery. Ensure someone is available to receive the order. Address changes are not allowed.
Orders are securely packed and shipped. Tracking details will be shared post-dispatch. Delays may occur due to external factors.
If the recipient is unavailable, two delivery attempts will be made. After that, the order will be marked as delivered.
Special Delivery Locations
Hospitals:
Provide hospital name, address, contact number, recipient name, and room/ward number. ICU deliveries may be restricted.
Hotels:
Provide hotel details, recipient name, contact number, and room number. If the recipient has not checked in or has checked out, the order will be considered delivered.
Wedding Halls:
Provide alternate recipient details. If unavailable, delivery will be made to a family member.
Hostels/PG/Cantonment:
Recipient must collect from gate/security/reception. Order will be considered delivered once handed over.
Remote Locations
Deliveries depend on service availability. Exact delivery times cannot be guaranteed. Perishable items may not be available in all locations.
No deliveries on national holidays. Orders may be rescheduled due to unavoidable events like weather, strikes, or restrictions.
Restricted Locations
We do not deliver to railway stations, metro stations, or airports.
Deemed Delivery
WishiWish will attempt delivery only once. If unsuccessful due to:
- Incorrect address
- Recipient unavailable
- Premises locked
- Refusal to accept
The order will be considered delivered and no refund/cancellation/modification will be allowed.
To maintain surprise deliveries, we may avoid contacting the recipient directly.
Proof of Delivery
Upon delivery, acknowledgement may be requested. If refused, confirmation sent by WishiWish via email/SMS shall be treated as valid proof of delivery in case of disputes
- Duplicate order
If you have placed two or more identical orders by mistake, you shall inform the same to WishiWish. WishiWish shall give a full refund for the duplicate order, provided that the order has not been prepared or delivered. In any case WishiWish discovers that the same order has been made twice, it shall try to contact the customer to confirm the order. If the customer is not contactable, WishiWish shall be free to take the final decision on behalf of the customer.
- Payment terms
You agree to pay the price applicable and displayed for the product or service on our Website at the time you submitted your order, the delivery fees for the delivery service you selected, if any, and any applicable taxes (defined below). You will be solely responsible for payment of all taxes (other than taxes based on WishiWish’s income), fees, duties, and other governmental charges, and any related penalties and interest, arising from the purchase of the products and services not withheld by WishiWish.
All payments are non-refundable (except as expressly set forth in these Terms and Conditions). We reserve the right to charge late fees on all due payments required to be made by the customer, which shall be equivalent to the higher of:
a) 1.5% (one point five percent) per month on the unpaid balance; or
b) the highest rate prescribed under applicable law.
You agree to pay for all collection costs, attorney’s fees, and court costs incurred in the collection of past due amounts.
“Convenience Charge” may be levied by WishiWish for facilitation of choosing product(s) and booking last moment delivery anywhere in India. This covers WishiWish’s internet and system handling costs.
Such Convenience Charges are correlated to the order value.
- Payment details
Order delivery is totally subjected to the payment credited in WishiWish’s account. Unless payment is received by us, the order will not be processed. WishiWish accepts payment via Visa, Master Card, RuPay, PayPal and American Express Debit and Credit Cards, Internet Banking, Digital wallets and UPI. All domestic and international cards are accepted by WishiWish.
You acknowledge that while making a transaction on the Website, you are not using any Credit or Debit card, digital wallet or UPI ID fraudulently and that you are duly authorized to use such card or payment mechanism. You agree to provide accurate and correct information of your card or payment mechanism for such transactions. The liability for fraudulent use of a card or any payment mechanism will be solely on you, and the onus to prove otherwise shall be exclusively yours. WishiWish does not take responsibility for any transaction processed without your consent or knowledge. The cardholder or holder of any payment mechanism shall be solely liable for the transactions and the amount charged on his/her account.
All payments made against purchases on the Website shall be in Indian Rupees (INR), as acceptable in the Republic of India. The Website will not facilitate transactions in any other currency with respect to purchases made on the Website.
Before shipping or delivering your order, WishiWish may request supporting documents (including but not limited to government-issued ID) to establish ownership of the payment instrument used for the purchase. This is done to ensure a safe and secure online shopping environment.
It is further clarified that:
Transactions, transaction price, and all commercial terms such as delivery and dispatch of products are on a principal-to-principal basis between the customer and:
a) WishiWish, and the payment facility provided on the Website is merely used by the customer and WishiWish to facilitate the completion of the transaction.
b) You understand, accept and agree that the payment facility made available on the Website is neither a banking nor a financial service but is merely a facilitator providing an electronic, automated online payment system, including UPI payments through WhatsApp/Telephonic Channel, using existing authorized banking infrastructure and payment gateway networks.
- Communications
Subject to the terms of use and your registration on our Website, you agree to receive communications from us by e-mail, SMS, or any other communication made electronically, verbally, or physically through post. You agree that all agreements, notices, disclosures, and other communications that WishiWish provides to you by e-mail or through any of the aforementioned mediums satisfy any legal requirement that such communications be in writing.

WishiWish, being an occasion-based gifting business, provides certain occasion reminder services wherein WishiWish may remind you in future year(s) about specific occasions. For this purpose, you agree to provide your consent to be contacted by WishiWish through SMS, phone calls, and e-mail on your registered contact details to assist you with this complimentary reminder service.
- Feedbacks and Suggestions
At WishiWish, we make every effort to ensure that you receive excellent products and services. We strive not only to meet but exceed your expectations. Note: Complaints must be raised within 2 hours from the time of delivery, failing which we will not be able to register the complaint. Complaints regarding non-delivery must be raised within 24 Hours from the date of delivery. In case of a defect, we will arrange a replacement. For quality verification, we may initiate a reverse pickup before processing the replacement.
- Returns and refund policy

No returns are allowed. However, if the product received is damaged, defective, or incorrect, please report the issue to our customer support team within 2 hours of delivery, along with an image of the item delivered. Our team may contact you for additional details if required.
You may choose one of the following options:
- Re-delivery of the product, or
- Refund in the form of a gift certificate (processed within 24 hours), or
- Refund to the original mode of payment (credited within 7–10 working days as per standard banking timelines)
Refunds Will Not Be Applicable In The Following Cases:
- If flowers, plants, cakes, sweets, or other perishable items are delivered to an incorrect address provided by the sender
- If the recipient is not available at the delivery address or refuses to accept the delivery

Refund Processing
Online refunds will be processed by WishiWish upon confirmation via email or phone call. Once processed, the amount may take 10–15 business days to reflect in your account, depending on standard banking timelines.

If WishiWish is unable to deliver your order, a full refund will be issued. However, WishiWish shall not be liable for any additional charges, loss of profits, emotional distress, or any other consequential liability arising due to such non-delivery.
17. Fraudulent transactions
If WishiWish finds any customer involved in any fraudulent transaction on the Website, it may recover the cost of products, collection charges, and lawyer’s fees from the concerned customer using the Website fraudulently. Such recovery shall not prejudice the rights of WishiWish to initiate legal proceedings against such customer for his/her unlawful activities.

Due to a high volume of orders during Valentine’s day, Diwali, Raksha Bandhan, Dussehra, Holi, Ganesh Chaturthi, Eid, Christmas, delivery status confirmations via email and SMS may be delayed. WishiWish strives to ensure timely delivery of all orders; however, in case of delays due to increased demand, WishiWish will inform you and make every effort to deliver your order as soon as possible.
WishiWish’s customer care team works diligently to provide a seamless experience. However, during peak periods such as Valentine’s day, Diwali, Raksha Bandhan, Dussehra, Holi, Ganesh Chaturthi, Eid, Christmas, response times may be slightly delayed. We request your patience during such times. If you have contacted us via email, please be assured that your query is being reviewed and will be responded to at the earliest.
While we make every effort to deliver orders promptly, due to high demand during these peak seasons, fixed-time delivery cannot be guaranteed. Orders are processed on a first-come, first-served basis, depending on delivery areas and local conditions. For products shipped through courier partners during peak periods, WishiWish does not guarantee an exact delivery date or time.

Losses
WishiWish shall not be liable for any business losses (including loss of profits, revenue, contracts, anticipated savings, data, goodwill, or wasted expenditure) or any indirect or consequential loss that was not reasonably foreseeable at the time you began using the Website.
